Everything You Need to Know.
At Trusted Cars Ltd. we work hard to provide an efficient, professional and reliable service and pride ourselves on our strong and lasting customer relationships. Below are our Terms and Conditions of Hire, which are intended to provide clarity in expectation and to protect both ourselves and our customers. By booking a Trusted Cars private hire vehicle, you automatically agree to these Terms and Conditions as set out below, please take time to read them. In accordance with British law, seat belts MUST be worn.

Terms + Conditions
In accordance with British law, smoking is not permitted in any Trusted Cars Ltd vehicle at any time.
The consumption of food is not permitted in any vehicles unless specific agreement has been made to the contrary at the time of booking and/or agreed with the driver. The driver has the right to refuse if he feels that damage or accidents could occur.
The hirer is responsible for the general conduct and behaviour of his or her party. A charge of £80.00 will be levied to cover the cleaning costs in the unlikely events that the vehicle is soiled by any passenger.
The company and its drivers have the right to refuse to carry any passenger who is thought to be under the influence of alcohol or drugs and whose behaviour poses a threat to the driver, the vehicle or any other passenger.
Every effort will be made by the company to ensure that vehicle(s) arrive on time and reach destinations on time. The company shall not be held responsible or liable for any delays (and/or arising consequential losses) that occur beyond its control.
The driver will travel by the most appropriate route on the day unless instructed otherwise by the customer.
In the unlikely event that we are unable to complete a booking due to circumstances beyond our control, a full refund will be given. Beyond this, we are not liable for any additional costs incurred or the loss of any monies paid by the client.
Although we will take care, we will not be responsible for the loss or damage to luggage or personal property left in the vehicle during or after the hire period.
Our vehicles are serviced and maintained to the highest levels however in the unfortunate event of a breakdown Trusted Cars Ltd cannot be held responsible. Another vehicle will be dispatched as soon as possible, and all vehicles have full breakdown cover to assist in a speedy completion of the journey.
Because of on-going security measures and the resultant delays affecting the processing and collection of passengers from UK airports, all parking charges will be paid by the hirer.
All incurred tolls will be paid by the hirer.
In the event of a complaint, the hirer is welcomed to contact the office to give notice of the complaint. A form will be duly sent out for the hirer to log said complaint for the company to deal with appropriately. Trusted Cars Ltd are instructed to hold a full and accurate record on file of complaints about its governing authority AVDC (Aylesbury Vale District Council).
In the unlikely event of an event of a dispute arising, notice must be given within 21 days of the invoice date or job completion date. In the event of no such notification being received by the company, the hirer shall accept the amount as being properly due and shall not be entitled to dispute this sum.
Trusted Cars Ltd will refuse or terminate any booking with immediate effect if it places any driver or vehicle at risk of damage, violence or abuse by you or your passengers, requesting that all passengers vacate the vehicle when it is safe and appropriate to do so.
We reserve the right to charge a late fee on any invoices that are overdue, the first charge will usually be applied 7 days after the due date (30 days) and incremented every 7 days after this date. Any late payments will trigger a fee of 8.00% per month on the amount still owing.
If you need to cancel your booking please contact Trusted Cars Ltd office as soon as possible. Cancellations up to 24 hours before will not be liable for extra charges.
Within 12 hours of the booking will be liable to discretionary charges, and cancellations up to and including 1 hour are liable for charges of up to 100%. These charges will be confirmed on cancellation.
Refunds will be given at the discretion of the management.
All account invoices shall be settled by return upon receipt of the original invoice. Trusted Cars Ltd will invoice account customers at the end of every month.
Account customers of the American Government and US Armed Forces that require transport will be requested to provide an official Purchase Order number from the appropriate US authorities. This coincides with US authorities and HM Customs and Excise arrangements. (Reference PRIV) 46/7).
Contracted Works
Force Majeure
An event beyond the reasonable control of the parties to this agreement is a Force Majeure Event and shall include such events as an act of God, fire, flood, storm, war, riot, civil unrest, an act of terrorism, strikes, industrial disputes, an outbreak of epidemic or pandemic of disease, failure of utility service or transportation.
Notification
If Trusted Cars Ltd are prevented from or delayed in carrying out its obligations under this agreement by a Force Majeure Event, the party shall immediately notify the other and shall be excused from performing those obligations while the Force Majeure Event continues.
Continued Force Majeure
If a Force Majeure Event continues for a period greater than 90 days, the party who has provided notification under notification clause above shall notify the other of the steps to be taken to ensure the performance of this agreement. If the government have intervened, then both parties are to wait until government lift travel restrictions.
Travel commencement from Force Majeure
Once restrictions are lifted Trusted Cars Ltd shall commence travel services as complete as possible, given period of Force Majeure has not affected licenses base passes and driver/ company circumstances. Both parties shall be informed of delays and services ahead of the commencement of transportation services.
Reimbursement of monies paid will be honoured after the period of 90 days without having provided school transport. A sliding percentage scale shall be calculated and returned or credited to the account.
A time-controlled three-banded scale providing reimbursement will be triggered after an agreed period.
Band 1 – 35% Band 2 – 50% Band 3 – 75%
Any reimbursement thereafter will be mutually agreed by the management.
Trusted Cars Ltd will be reimbursed from time to time for reasonable and necessary expenses incurred by the Contractor in connection with providing the Services. Trusted Cars Ltd will only be reimbursed for expenses submitted according to the following guidelines:
- Trusted Cars Ltd will be reimbursed for extra journeys caused by and “Special Circumstances”
- The Client must sign a chitty; as confirmation of extra expense chargeable.
Confidential information (the “Confidential Information”) refers to any data or information relating to the business of the Client which would reasonably be considered to be proprietary to the Client including, but not limited to, accounting records, business processes, and client records and that is not generally known in the industry of the Client and where the release of that Confidential Information could reasonably be expected to cause harm to the Client.
Service Agreement
Trusted Cars Ltd agrees that they will not disclose, divulge, reveal, report or use, for any purpose, any Confidential Information which the Contractor has obtained, except as authorised by the Client or as required by law. The obligations of confidentiality will apply during the Term and will survive indefinitely upon termination of this Agreement.
All written and oral information and material disclosed or provided by the Client to Trusted Cars Ltd under this Agreement is Confidential Information regardless of whether it was provided before or after the date of this Agreement or how it was provided to the Contractor.
Ownership of Intellectual Property
All intellectual property and related material (the “Intellectual Property”) that is developed or produced under this Agreement, will be the property of the Contractor. The Client is granted a non-exclusive limited-use license of this Intellectual Property.
Title, copyright, intellectual property rights and distribution rights of the Intellectual Property remain exclusively with the Contractor.
Return of Property
Upon the expiry or termination of this Agreement, Trusted Cars Ltd will return to the Client any property, documentation, records, or Confidential Information which is the property of the Client.
Capacity/Independent Contractor
In providing the Services under this Agreement it is expressly agreed that Trusted Cars Ltd are acting as an independent contractor and not as an employee. Trusted Cars Ltd and the Client acknowledge that this Agreement does not create a partnership or joint venture between them, and is exclusively a contract for service.
Right of Substitution
Except as otherwise provided in this Agreement, Trusted Cars Ltd may, at their absolute discretion, engage a third party sub-contractor to perform some or all of the obligations of Trusted Cars Ltd. under this Agreement and the Client will not hire or engage any third parties to assist with the provision of the Services.
In the event that Trusted Cars Ltd hires a sub-contractor Trusted Cars Ltd Will pay the sub-contractor for its services and the Compensation will remain payable by the Client to Trusted Cars Ltd. for the purposes of the indemnification clause of this Agreement, the sub-contractor is an agent of Trusted Cars Ltd.
Autonomy
Except as otherwise provided in this Agreement, Trusted Cars Ltd will have full control over working time, methods, and decision making in relation to the provision of the Services in accordance with the Agreement. Trusted Cars Ltd will work autonomously and not at the direction of the Client. However, Trusted Cars Ltd will be responsive to the reasonable needs and concerns of the Client and services remain open to instruction changes and bookings remain of flexible nature until guidelines set out in the above Service Agreement.
Equipment + Risk Assessment
Except as otherwise provided in this Agreement, Trusted Cars Ltd will provide at the Trusted Cars Ltd own expense, any and all tools, machinery, equipment, raw materials, supplies, workwear and any other items or parts necessary to deliver the Services in accordance with the Agreement.
Trusted Cars Ltd will provide a risk assessment for travel services. Trusted Cars Ltd can produce this upon request to the office. Email chris@trustedcars.co.uk
No Exclusivity
The Parties acknowledge that this Agreement is non-exclusive and that either Party will be free, during and after the Term, to engage or contract with third parties for the provision of services similar to the Services.
Nothing in these Terms and Conditions of Hire can affect your statutory rights. We reserve the right to alter these Terms and Conditions of Hire at any time and without notice.
